1/ Where there is recognised insanity (by the medical authorities) for at least two years prior to the divorce action.\r 2/ Irreconcilable Differences - This is a very common cause for divorce, and is often cited where couples have simply stopped communicating any more, and are no longer working effectively together as a team.\r 3/ Where the two people in the marriage have been living apart and separately for a period of more than a year.
With regard to these three conditions, the parties do not have to prove allegations of adultery, or mental cruelty in order to get a divorce. It is important to point this out, because this does vary between the different states; and some in fact do have this as a requirement still.
In order to get a divorce in Nevada it is necessary to have had at least six weeks prior residence in the State, and to have a witness available who can attest to that fact.
With regard to the actual divorce case itself, there are number of factors that the court will have to consider when exploring whether or not to grant a divorce. These include:
1/ How to divide the marital assets - Such as property, belongings etc.
\r 2/ Custody considerations if there are children (and sometimes for pets as well!)
\r 3/ Confirmation of the Marital Status - In order to get a divorce in Nevada (or anywhere for that matter) you first have to be married. And so it is an imperative on the court that it is checked that the initial wedding was in fact binding from a legal perspective.
\r 4/ Alimony Payments - Whether either spouse will in fact get alimony payments after the divorce from the other party (in many marriages where one party is rich, they will insist on a pre-nuptial agreement so that this is avoided)
These are the key areas in a divorce in Nevada. Though, they hide the very real pain that going through this process causes, it does at least point out some of the steps and procedures for dealing with a divorce in Nevada from a legal perspective.
